The agreement between you and Phizzy.
By creating an account or using Phizzy, you agree to these Terms of Service. If you don't agree, don't use the app.
You must be at least 13 years old to use Phizzy. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to terminate accounts of users under 13.
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us at support@phizzy.app if you believe your account has been compromised. You agree to provide accurate information when creating your account and to keep it up to date.
You retain ownership of the content you create in Phizzy — your records, photos, posts, comments, and other contributions ("Your Content").
By posting Your Content to public-facing parts of the app (the feed, your public profile, comments), you grant Phizzy a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute Your Content within the app and in connection with operating the service. This license ends when you delete Your Content or your account, except where the content has been shared with others or is required to be retained for legal compliance.
You are responsible for Your Content. Don't post anything that infringes someone else's rights, breaks the law, or violates these Terms.

We may suspend or terminate accounts that violate these rules.
Phizzy compiles record metadata, pricing data, rarity scores, and other information from third-party sources (including Discogs, Spotify, and Apple) and from our own analysis. This data is provided for informational purposes only and may be incomplete or inaccurate. We make no warranty about the accuracy of any record valuation, market data, or rarity score shown in the app. Don't rely on Phizzy data for high-stakes financial decisions without independent verification.
Phizzy may offer paid features in the future. If you subscribe to a paid plan, the terms of that subscription (price, billing period, cancellation) will be presented to you before purchase and will govern that subscription. Apple App Store and Google Play handle the payment, refunds, and renewal of subscriptions; their policies apply to those transactions.
Phizzy relies on services from Google (Firebase, Gemini, Cloud Vision), Discogs, Spotify, Apple, and Mapbox to function. Your use of features that interact with these services is also governed by their respective terms. We are not responsible for the practices of these third parties.
Phizzy, the Phizzy name, our logos, and the design and code of the app are owned by us. Nothing in these Terms grants you any right or license to use those marks or that material outside of normal use of the app.
If you believe content in Phizzy infringes your copyright, send a notice to support@phizzy.app with the information required by the DMCA (17 U.S.C. § 512). We will respond as required by law.
PHIZZY IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
We do not guarantee the accuracy of record valuations, rarity scores, market data, or any other information shown in the app.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHIZZY AND ITS OPERATOR ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID PHIZZY IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $50.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above may not apply to you.
You can stop using Phizzy at any time and delete your account from Settings → Delete Account.
We may suspend or terminate your access to Phizzy at any time, with or without notice, if we believe you have violated these Terms or pose a risk to the service or other users. On termination, your right to use the app ends, but Sections 3 (the license you've granted in Your Content), 9, 10, 12, and 13 survive.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of Phizzy will be brought in the state or federal courts located in New York County, New York, and you consent to the jurisdiction of those courts.
If you are a consumer in the European Union, the United Kingdom, or another jurisdiction whose law grants you mandatory rights, nothing in this section overrides those rights.
We may update these Terms. If we make material changes, we will notify you in-app and by email (if you've provided one) at least 30 days before the change takes effect. Your continued use after the effective date constitutes acceptance of the updated Terms.
